1. Introduction
Welcome to Cybronical Technologies! These Terms and Conditions (the "Agreement") govern your use of our website, services, and products. By accessing or using our website and services, you agree to comply with and be bound by these Terms and Conditions. Please read this Agreement carefully.
2. Payment Terms
2.1 Software, Website, and Application Development
For projects related to software, website, and application development, the payment terms are as follows:
Fifty percent (50%) of the agreed project amount must be submitted by the client upon signing the contract.
Twenty-five percent (25%) of the agreed amount is due upon the release of the Alpha version.
The remaining twenty-five percent (25%) is payable upon the final release of the project.
2.2 Graphic Designing and Marketing
For graphic designing and marketing projects, the payment terms are as follows:
One hundred percent (100%) of the agreed project amount must be submitted by the client at the time of signing the contract.
3. Change Requests
3.1 Software, Website, and Application Development
If, after confirming the required functionalities, features, and appearance of the project, the client requests changes that involve adding, removing, or modifying features, functionality, or appearance, Cybronical Technologies will not be responsible for any additional costs and time incurred. Any such changes will be subject to a separate agreement and may result in an adjustment to the project timeline and cost.
4. Intellectual Property Rights
Cybronical Technologies retains all intellectual property rights associated with the work created for clients during the project, unless otherwise specified in the contract.
5. Confidentiality
Both Cybronical Technologies and the client agree to maintain the confidentiality of any proprietary or confidential information exchanged during the course of the project.
6. Termination of Services
Either party may terminate the contract with written notice if the other party breaches any material provision of this Agreement. Termination may result in the client forfeiting any payments made up to that point.
7. Limitation of Liability
Cybronical Technologies shall not be liable for any indirect, consequential, or incidental damages arising out of or related to the use of our services or products.
8. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of concernd Jurisdiction. Any disputes arising under or in connection with this Agreement shall be resolved through arbitration in accordance with the rules of the Arbitration Association.
9. Changes to Terms and Conditions
Cybronical Technologies reserves the right to modify or revise these Terms and Conditions at any time. The updated terms will be posted on our website, and it is the client's responsibility to review them periodically.
10. Confidentiality and Project Hosting
10.1 Confidentiality
For security reasons, Cybronical Technologies does not share the working files of projects with clients unless explicitly agreed upon in writing prior to the agreement. We maintain strict confidentiality of our project files to protect intellectual property and sensitive information.
10.2 Project Hosting
Cybronical Technologies does not allow clients to host our projects on external servers without prior written consent. If a client wishes to host a project on their own server or on a server of their choosing, they must make this request in writing before entering into the agreement. Any hosting arrangements will be subject to a separate agreement and may incur additional fees.
By entering into an agreement with Cybronical Technologies, clients acknowledge and agree to adhere to these confidentiality and project hosting terms for the protection of all parties involved.
